Death & Estate Taxes
Estate Planning
We have extensive experience assisting executors and families with estate and deceased tax matters, including:
• Final (terminal) personal tax returns
• T3 Trust returns
• Clearance Certificate applications
• CRA correspondence and compliance for estates
We guide executors through the process step-by-step to ensure all tax obligations are met accurately and efficiently during an already difficult time.
Canada does not have an inheritance tax. Beneficiaries generally do not pay tax simply for receiving an inheritance. However, taxes may arise on the deceased’s final tax return due to rules such as deemed disposition.
Deemed disposition means the CRA treats many assets as if they were sold at fair market value immediately before death, even if they were not actually sold. This can trigger capital gains tax on items such as non-registered investments and certain real estate.
Common filings may include the Final (Terminal) T1 return for the deceased and, where applicable, a T3 Trust return for the estate (to report income earned after death). Additional optional returns may be available depending on the situation.
A Rights or Things return is an optional return that can report certain amounts owed to the deceased at death (depending on the facts). When available, it may allow a second set of personal tax credits and potentially lower overall tax by spreading income across returns.
A Graduated Rate Estate (GRE) is a special estate status that may allow the estate to use graduated tax rates for a limited period after death, subject to eligibility and compliance. Proper filings and timelines matter to preserve this benefit.
If no eligible rollover applies, the value of an RRSP or RRIF is generally included as income on the deceased’s final return, which can create a significant tax bill. In certain cases (for example, spouse/common-law partner rollovers), tax can be deferred.
A CRA Clearance Certificate helps confirm that required returns are filed and taxes are paid before the executor distributes estate assets. Distributing assets without clearance can expose the executor to personal liability if taxes are later assessed.
Processing times vary based on the estate and CRA workload. In many cases, it can take several months. Executors should plan distributions carefully and seek guidance on timing and documentation.
In general, beneficiaries do not pay tax just for receiving an inheritance. Taxes are typically addressed at the estate level or on the deceased’s final return, depending on the type of asset and income involved.
